It is a matter of fact that it is also not permitted to publish: pornographic content and content falling under criminal law, such as propaganda material and signage of unconstitutional organisations according to German law (§ 86StGB, § 86 a StGB, § 4 Abs. 1 Nr. 1 und 2 JMStV) sedition and the public denial of the Holocaust (§ 130 StGB, § 4 Abs. 1 Nr. 3 und 4 JMStV) perpetration of or instructions for criminal acts (§§ 111, 130 a StGB , § 4 Abs. 1 Nr. 6 JMStV) gruesome depictions of violence (§ 131 StGB, § 4 Abs. 1 Nr. 5 JMStV) child pornography, bestiality and pornography depicting extreme violence (§§ 184a, b StGB ff.; § 4 Abs. 1 Nr.10 JMStV) erotic depiction of minors (§ 4 Abs. 1 Nr. 9 JMStV) contents that glorify war (§ 4 Abs. 1 Nr. 7 JMStV) abuse of human rights (§ 4 Abs. 1 Nr. 8 JMStV) telemedia that is on the index according to the German Penal Code and identical telemedia (§ 4 Abs. 1 Nr. 11 JMStV) contents that play down alcohol abuse (dd) Sanctions F.W. Langguth Erben GmbH & Co. KG will sanction offences against these terms and conditions. The sanctions range from the deleting of the content to the exclusion from the community. Users who breach these duties stated in the terms and conditions are obliged to reimburse F.W. Langguth Erben GmbH & Co. KG if expenses occur. (ee) Responsibility, liability and release According to the Telemedia Act and jurisdiction the provider of content is responsible for all original material made available (texts, images, drawings or videos). The users accept and guarantee that F.W. Langguth Erben GmbH & Co. KG may publish uploaded contents and guarantee that they are not violating copyrights, patents, registered designs, design patents, brands, trade secrets or any other sort of property rights or rights of privacy concerning third parties. In the case of a claim by third parties is raised based upon content made available by users these users indemnify F.W. Langguth Erben GmbH & Co. KG upon first request from the claims and costs of legal representation. All services are subject to the general terms and conditions. (ff) Rights to the content By creating his or her own content (text, image, drawing or video) the user grants permission to F.W. Langguth Erben GmbH & Co. KG to use and publish this content free of charge, indefinitely and in an unlimited manner, or to have it published, to redistribute it and / or have it redistributed, as well as making it publicly available to third parties (copying, distribution, recitation rights and broadcasting rights). The user will, in principle, not receive any kind of remuneration of any sort for the granting of the rights regarding the use of his or her content. The §§ 32 ff of the German Copyright Law are excluded. (gg) Blocking of the account The users can have their account blocked at any given point in time. Their data will then be blocked with the exception of the content that has been generated by the user. F.W. Langguth Erben GmbH & Co. KG can block a user if the membership has been dormant for a period of more than six months. If the general terms and conditions or the terms for the registration are violated F.W. Langguth Erben GmbH & Co. KG reserves the right to permanently exclude a user from entering content. The persecution of legal consequences remains unaffected by this. (hh) Adapting the rules of registration These rules of registration can be changed at any given point in time. If F.W. Langguth Erben GmbH & Co. KG changes anything then F.W. Langguth Erben GmbH & Co. KG will inform the users of these changes by e-mail and request their agreement during the following log in process or during the next registration.
